Whistleblowing to the Isle of Man Financial Services Authority (‘the Authority’)
The Isle of Man has provisions under the Employment Act 2006 to protect workers who make disclosures about wrongdoing to their employer. The provisions are summarised in the Isle of Man Government’s A Brief Guide to Whistleblowing.
Regulated entities are obliged to have an internal whistleblowing policy in place.
Serious concerns can also be reported to the Authority about regulated entities, ideally after raising them directly with the employer and if the whistleblower remains unsatisfied at the end of the employer’s process. The Authority is a prescribed person under the Public Interest Disclosure (Prescribed Persons) Order 2016 which means that any dismissal of the whistleblower would be automatically unfair if the principal reason for dismissal is that they have made a protected disclosure to the Authority in good faith.
